II. ORDER & PAYMENTThe products are presented on the website with characteristics. The customer can choose to purchase any product, with an indicated price, for which the customer have to add to cart, acknowledge and accept the Terms by checking a box during the checkout process, process to payment. The customer then receives a confirmation email on the email address the customer specified during the payment process. The customer will be charged the price for the purchased product plus delivery charges once the availability of the product is confirmed.
POC reserves the right to refuse an order for any reason that leads to difficulty to treat the order, such as unavailability of product. In any case, an information email is sent to the customer to keep his informed and any made payment is cancelled.
III. PRICEThe products prices are fixed by POC and the products owners. POC reserves the right to modify the prices at any time with the products owners’ agreement. However, any product is invoiced on the price applicable at the time of order.
The products prices are stated in Euros but excluding shipping costs that will be specified during the payment process. If customs duties, local taxes or import duties are payable, these rights are the responsibility of the customer and under its full responsibility, both in terms of returns and payments to the authorities or competent organization. It is recommended to check with the relevant authorities.
IV. SHIPPING & DELIVERYThe purchased product is shipped to the address provided by the customer during his order, within 7 to 10 business days. If any delay occurs, an email is sent to the customer to inform of the impact on the delivery time. The name of the carrier dealing with the transport of the purchased products to the customer as well as the number of the packages are communicated to the customer by email. This allows the customer to track the status of its order on the carrier's website, provided that the carrier offers a package tracking service. POC and the products owners are not responsible for delivery delay caused exclusively by the customer’s unavailability to receive the package from the carrier.
V. RIGHT OF WITHDRAWALThe right of withdrawal (governed by Legislative Decree No 21/2014 which transposed Directive 2011/83/EU on consumer rights) allows a European consumer to change his mind about the purchase made, freeing himself from the contract concluded without giving any reason. In this case, the consumer can return the goods and obtain a refund of the amount paid.
The consumer has to be established within the European Economic Area (member countries of the European Union as well as Iceland, Norway and Liechtenstein). For any purchase made from a provider that is not a member of the European Economic Area or if the customer is not a national of this area himself, this right of withdrawal is not applicable.
The withdrawal period begins in the case of selling goods at distance as soon as the consumer has received the goods. If the consumer ordered multiple goods and the goods are delivered separately, as soon as the consumer received the last goods.
To exercise the right of withdrawal, you must inform us of your decision to withdraw from this contract by an unequivocal statement sent via our contact form: https://photographyofchina.com/contact. You may use the below model withdrawal form, but it is not obligatory:

If you withdraw from this contract, POC shall reimburse to you all payments received from you, including the costs of delivery, without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. POC will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement. POC may withhold the reimbursement until he has received the goods back or until the consumer has supplied evidence of having sent back the goods (e.g. deposit receipt).
The consumer is obliged to return the goods in their original packages without undue delay and in any event not later than 14 days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of 14 days has expired. Customer will have to bear the direct cost of returning the goods.
Customer are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods. If POC receives goods that are dirty or even damaged, compensation is possible under certain conditions.
VI. GUARANTEEAll the products available on POC website are confirmed entirely original. In case of non-conformity of a sold product, it can be returned, changed or repaid. Any complain, change or repay request has to be made by email within 30 days from the products receipt date. Products return has to be done in the original and complete status (packaging, accessories...). Returns fees are repaid to the customer upon presentation of receipts. This article does not prevent the customer from using your right of withdrawal allowed by article V.
VII. PRIVACY POLICYPOC can collect nominative information and personal data about the customer. It is necessary to process order and to improve services and information POC is providing to the customer. The information and data can also be transmitted to companies, which contribute to these relations, such as those who process order operations and payment.
The information and data are also preserved for security purpose in order to comply with legal and regulatory obligations. In no way these information and data will be transmitted to third parties companies with commercial purpose without your written authorization.
VIII. APPLICABLE LAW IN CASES OF DISPUTEThe current Terms are under French legislation and the French courts will have exclusive jurisdiction for any dispute under this agreement. Any situation non provided in the current Terms shall first lead the parties to make all possible efforts to resolve the dispute amicably.
